CONDITIONS FOR ENTRY AND DATA PROTECTION
COMPETITION “EDAG X Formula Student Newsletter”
Conditions for entry
a. Name of the organizer
The draw is being carried out by EDAG Engineering GmbH, Kreuzberger Ring 40, 65205 Wiesbaden (hereinafter referred to as "EDAG Group").
b. Eligibility
The competition is open to persons who are members of a Formula Student team and have reached the age of 18 on the day of participation.
EDAG employees are excluded from participation.
c. How the competition works
To participate in the competition, register for the "EDAG x Formula Student Newsletter" (https://deeper-insights.edag.com/en/edag-formula-student-newsletter-subscribe), and confirm your participation in the competition and the corresponding terms and conditions for entry by ticking the checkbox ("I am taking part in the competition and hereby accept the terms and conditions for entry."). The landing page link for newsletter registration is provided via a QR code. The competition starts on 7/21/2025 and ends on 7/25/2025. The winners will be selected in a random draw from all entries on or before 8/8/2025.
d. Description of the prize
A pavilion measuring 3x3 meters, in the EDAG design, and with a value of €1,100.00 will be awarded by in the draw, from all valid entries.
The right to a prize is non-transferable. Entitlement to a prize shall lapse if the winner is not available, fails to respond within three days of being notified of the prize or fails to claim his or her prize.
All decisions are final; there is no right of appeal, and no cash prizes will be awarded.
e. Prize notification
If you win, you will be notified by email by 9/8/2025. If you fail to confirm your acceptance of the prize within three days, your claim to the prize will lapse. In this case, a new winner will be determined in line with the process described above.
f. Manner of prize delivery
The prize will be ordered from the supplier after the winner has been announced. Once the pavilion has been delivered, an appointment will be scheduled for the personal handover of the prize, which will be carried out by an EDAG employee.
g. Disclaimer
EDAG would like to point out that the availability and function of the competition cannot be guaranteed. The competition may be terminated or eliminated, particularly on account of external circumstances and constraints, without giving the participants any entitlement to bring claims against EDAG. External circumstances and constraints may include technical problems, legal amendments or third-party actions over which EDAG has no control. EDAG shall be released from all obligations at the time the prizes are awarded, unless another, earlier point in time should result from these provisions. EDAG shall not be liable for material defects and/or defects of title in prizes donated by cooperation partners, nor for the insolvency of a cooperation partner, nor for any consequences resulting therefrom for the implementation and handling of the competition.
EDAG shall only be liable for damage caused intentionally or through gross negligence or through the violation of cardinal obligations by EDAG or one of its vicarious agents. This limitation of liability shall apply in particular to damage caused by errors, delays or interruptions in the transmission of data or similar, in the event of faults in technical equipment or service, incorrect content, loss or deletion of data. In all other respects, liability shall be excluded. The above limitations of liability shall not apply to damage caused by injury to life, limb and/or health or to claims under mandatory regulations such as the Product Liability Act.
h. Reservation to make alterations
EDAG reserves the right to replace the prize announced at any time with an equivalent prize of an average type and quality. Further, EDAG can change the game sequence concerned at any time. Plenty of advance notice will be given of any changes. EDAG reserves the right to cancel or terminate the competition for legitimate reasons at any time, without giving advance notice or stating the reasons. EDAG will make use of this option especially if, for either technical or legal reasons, or due to force majeure, it is not possible to guarantee that the competition will be carried out properly. EDAG will assume no liability for missed chances of winning on account of technical connection faults or similar. If any such termination is caused by the behavior of a participant, EDAG shall be entitled to demand compensation from this person for the damage incurred.
Data protection information for competitions and promotions
EDAG Engineering GmbH (hereinafter referred to as "EDAG") occasionally organizes competitions and promotions in which employees, customers and other interested parties can participate. In the following, we would like to inform you about the processing of your personal data in connection with these competitions and promotions in accordance with Article 13 of the General Data Protection Regulation (hereinafter “GDPR”). III. Description of data processing
1. Scope and purpose of data processing
If you participate in a competition or promotion, we will process the data and information you provide, e.g. in a registration form, competition form or other format. This includes any data required for you to participate, e.g.
First name
Team name
Email address
and any data and information you might have voluntarily provided when taking part.
Your personal data is processed for the purpose of transacting the competition or promotion, in particular to find and notify the winners.
We may subsequently collect and process additional data, e.g. your postal address, for the purpose of sending and delivering prizes.
The names of the winners may, in connection with their participation in the competition, the draw or handling by EDAG or a third party commissioned by EDAG, be publicly disclosed to third parties in online or offline media (for example, on the Instagram page, website or in print).
2. Legal basis for the processing of personal data
EDAG shall use the personal data of the winners only in compliance with the relevant data protection regulations and for the provision, implementation and handling of the competition or action and therefore on the basis of Art. 6 para. 1 sentence 1 point b of the GDPR. The competition will only be held as part of the registration for the "EDAG x Formula Student Newsletter" and the data collected as part of the registration will be processed in accordance with the "EDAG x Formula Student Newsletter" privacy policy.
3. Data erasure and storage period
We will store your personal data only for as long as is necessary for the execution of the competition. The deletion periods of the data protection information "EDAG x Formula Student Newsletter" shall apply.
Any deletion or withdrawal of the right to use personal data before the prize draw shall automatically cancel that person's competition entry.
Within our company, your data will only be shared with the people and departments, and only to the extent necessary for the proper performance of the processing purposes stated.
Some forms of processing are carried out with the help of specialized service providers, who perform IT or other services for us (e.g. email services and server provision). Suitable contractual regulations are in place to ensure compliance with data protection regulations.
4. Revocability of declarations of consent already given
If you have given your consent to the processing of your personal data, you are entitled to withdraw your consent at any time with future effect. The withdrawal of consent shall not affect the lawfulness of any processing carried out on the basis of your consent before its withdrawal. After withdrawal, EDAG may only continue to process the personal data insofar as EDAG has another legal basis on which to support such processing.
We draw your attention to the fact that withdrawal of your consent will result in your being excluded from further participation in the competition.
IV. Rights of Data Subjects
If personal data concerning you is processed, you are the data subject as defined in the GDPR, and have the following rights against the data controller:
1. Right to information
Within the scope of Art. 15 of the GDPR, you are entitled to request information about your data that is being processed by us at any time.
2. Right to rectification and completion
Should your personal data be incorrect or incomplete, you are entitled, within the scope of Art. 16 of the GDPR, to have it corrected or completed.
3. Right to restrict processing
Within the scope of Art. 18 of the GDPR, you may, if the legal conditions are met, request that processing of your personal data be restricted.
4. Right to deletion
Within the scope of Art. 17 of the GDPR, you may at any time request that your personal data be deleted, provided we are not legally obliged or entitled to further process your data.
5. Right to data portability
If processing is carried out on the basis of your consent and by automated means, then, within the scope of Art. 20 of the GDPR, you have the right to transfer the data provided by you, provided that the rights and freedoms of other persons will not be impaired as a result.
6. Right to object
Within the scope of Art. 21 of the GDPR, you have the right to object to the processing of your data for direct marketing or profiling purposes. You may, in accordance with Art. 6 para. 1 p. 1 point f of the GDPR, object to processing on the basis of an assessment of interests, stating the reasons arising from your particular situation.
7. Right to withdraw declaration of consent under data protection law
You have the right to withdraw your declaration of consent to the processing of personal data at any time. The withdrawal of consent shall not affect the lawfulness of processing based on your consent before its withdrawal (see point 5 above).
8. Right to lodge a complaint with a supervisory authority
Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement in accordance with Art. 77 GDPR if you consider that the processing of personal data concerning you infringes the GDPR. The supervisory authority with which the complaint has been lodged will inform the complainant on the progress and the outcome of the complaint including the possibility of a judicial remedy in accordance with Art. 78 of the GDPR.
