Data protection information for events and campaigns

DATA PROTECTION NOTICE FOR EVENTS AND CAMPAIGNS
PHOTO AND VIDEO RECORDINGS

EDAG Engineering GmbH (hereinafter "EDAG") occasionally organizes events and campaigns. We would like to inform you about the processing of your personal data in connection with these events and campaigns in accordance with Article 13 of the General Data Protection Regulation (GDPR). Additional information regarding data protection can be found at https://www.edag.com/en/legal/privacy-policy.

III. DESCRIPTION OF THE DATA PROCESSING

  1. Scope and Purpose of Data Processing
    a) Participants will be photographed or filmed during the event. It is possible that photos or videos of you – in groups, i.e., as a by-product of the visual coverage – may be shared on our websites and social media channels (Instagram, LinkedIn, etc.) in connection with the event. Conclusive behavior, such as posing or smiling at the camera, can be interpreted as implied consent, allowing us to use your direct image.
    The visual coverage of the event serves both our internal and external reporting purposes. If you do not wish to be part of the visual coverage of the event, please contact the responsible organizers at the start of the event or subsequently at ausbildung-studium@edag.com. We would like to point out that it may not always be possible for our dedicated photographers to comply with your wish not to be visually captured. We therefore ask you to adjust your behavior and avoid being photographed or filmed by the photographer.
    b) By participating in the event, you acknowledge that when published on the internet, personal data (including photos and videos) may be accessed and stored worldwide. These data may also be accessed through search engines. It cannot be ruled out that other individuals or companies may link this data with other personal data available on the internet, creating a personal profile, modifying the data, or using it for other purposes. You are aware that when published on social media, personal data may remain even after deletion from the respective services.
  2. Legal Basis for the Processing of Personal Data
    The photo and video recordings are based on our legitimate interest in public relations and documentation of our event. The legal basis for processing the data is Article 6(1) sentence 1 lit. f of the GDPR.
    If your implied consent (see section 1a) for direct photography is inferred from your behavior, Article 6(1) sentence 1 lit. a of the GDPR applies.
  3. Data Deletion and Retention Period
    Subject to your withdrawal (see section 5), we will retain your personal data as long as it is necessary for the above-mentioned purpose. Please note that deletion is only possible in accordance with section 1b.
  4. Recipients of the Data
    Your data will be shared on the above-mentioned EDAG websites and social media platforms. In connection with the publication of the photo and video recordings, they will also be accessible to visitors of the EDAG Group’s websites and social media pages, as well as recipients of the respective marketing materials (digital or print). In particular, access to our websites and social media pages is generally possible worldwide.
    The selection and posting of photos and video recordings from the event will be managed by our HR-Apprenticeship Team. Your personal data in the form of photos and video recordings are listed in section 1.
    For some processing, we make use of specialized service providers, who may provide IT or other services for us (e.g., email services and server hosting). We ensure compliance with data protection regulations through appropriate contractual arrangements.
  5. Revocation of Consent
    Under Article 21 of the GDPR, you have the right to object to processing at any time if a justifiable special situation arises.
    Subject to section 1b, if you have given us your implied consent (see section 1a) for the processing of your personal data, you have the right to withdraw your consent at any time with effect for the future (Article 7(3) of the GDPR). The withdrawal does not affect the legality of the processing that took place before the withdrawal based on the consent. After withdrawal, EDAG may continue processing your personal data only if it can base the processing on another legal ground.

IV. RIGHTS OF THE DATA SUBJECT
If your personal data is processed, you are the data subject within the meaning of the GDPR, and you have the following rights against the data controller:

  1. Right to Information
    You have the right to request information about your personal data being processed by us at any time, in accordance with Article 15 of the GDPR.
  2. Right to Rectification and Supplementation
    If your personal data is incorrect or incomplete, you have the right to request rectification and supplementation under Article 16 of the GDPR.
  3. Right to Restriction of Processing
    If the legal requirements are met, you have the right to request restriction of the processing of your personal data under Article 18 of the GDPR.
  4. Right to Erasure
    You have the right to request the erasure of your personal data under Article 17 of the GDPR, provided that we are not legally obligated or entitled to further process your data.
  5. Right to Data Portability
    If processing is based on your consent and carried out by automated means, you have the right to transfer the data you provided to us under Article 20 of the GDPR, provided that this does not affect the rights and freedoms of other persons.
  6. Right to Object
    You have the right to object to processing under Article 21 of the GDPR if the data processing is for direct marketing or profiling purposes. You can also object to processing based on a balancing of interests pursuant to Article 6(1) sentence 1 lit. f of the GDPR, providing reasons related to your particular situation.
  7. Right to Withdraw Consent
    You have the right to withdraw your data protection consent at any time. The withdrawal of consent does not affect the lawfulness of processing carried out based on consent before the withdrawal (see section 5).
  8. Right to Lodge a Complaint with a Supervisory Authority
    Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, particularly in the member state of your residence, your place of work, or the place of the alleged infringement, if you believe that the processing of your personal data violates the GDPR. The supervisory authority, where the complaint is lodged, will inform the complainant of the status and outcome of the complaint, including the possibility of judicial remedy under Article 78 of the GDPR.
